Abstract

La crise sanitaire du COVID-19 contribue à enrichir notre compréhension des modèles d'affaires des trolls de brevets. En se basant sur une analyse détaillée de la stratégie de l'entreprise FIG (dont les pratiques ont été mises au grand jour grâce à la crise COVID-19), notre recherche donne à voir une nouvelle génération de trolls de brevets qui repose sur un modèle d'affaires contaminant. Ces trolls ne se contentent plus d'extorquer directement les entreprises, mais agissent par le biais d'entités qu'ils financent et incitent à devenir elles-mêmes des trolls. Les stratégies de trolling se transmettent ainsi, sans mauvais jeu de mot, de manière virale. Cette crise nous aide donc à démasquer les trolls, qui avancent souvent cachés, et nous apprend qu'ils peuvent agir et répondre d'une manière totalement inattendue.
