Abstract

Les mesures agri-environnementales, les contrats agri-environnementaux notamment, ont été analysés comme un "alibi", dissimulant au fond un acte unilatéral émanant de l'administration et donc finalement comme des aides publiques sans contrepartie. Cette étude s'attache, à partir des notions juridiques d'objet et de cause du contrat, à réfuter une telle analyse et à démontrer que les aides agri-environnementales sont de véritables rémunérations pour services rendus par les agriculteurs. Elles ne peuvent de ce fait être considérées comme des barrières non tarifaires contraires aux engagements internationaux dans le cadre de l'Organisation mondiale du commerce (OMC).
