Abstract

Les institutions commerciales internationales entendent limiter l'utilisation par les Etats de barrières dites non tarifaires aux échanges. Ces réglementations sanitaires et techniques autorisées sont précisément définies. Dans les deux cas, les réglementations doivent remplir des objectifs dont le bien-fondé est scientifiquement avéré. Cependant, en matière de sécurité des aliments comme en matière de loyauté des échanges, les Etats doivent rester en mesure de répondre aux attentes de leurs consommateurs. Tout l'art de négociations reposera donc sur la capacité à présenter un dossier solidement argumenté, scientifiquement et juridiquement, de manière à affirmer de manière incontestable la légitimité et la pertinence des réglementations.
