Abstract

Les auteurs proposent un bilan critique des diverses mesures adoptées en France pour réguler les relations entre la grande distribution et ses fournisseurs, depuis la loi Royer de 1973 jusqu'à la récente loi relative aux nouvelles régulations économiques. Dans cet objectif, ils distinguent, d'une part, le contrôle des comportements qui repose sur le droit général de la concurrence ou sur des mesures spécifiques au secteur de la distribution et, d'autre part, le contrôle des structures de marché, avec en particulier le contrôle des concentrations et des implantations de magasins. Ils mettent en évidence l'existence d'un écart important entre les objectifs visés et les effets obtenus par ces diverses mesures de régulation. Si la récente loi sur les nouvelles régulations économiques apporte des modifications souhaitables, ils montrent que de nombreuses inefficacités de régulation demeurent.
