Abstract

Монография посвящена исследованию правовой природы правопрекращающих юридических фактов в механизме правового регулирования имущественных отношений, а также особенностей порождения ими последствий в форме прекращения прав, обязанностей и правоотношений, существующих между субъектами гражданского права. Рассмотрен механизм правопрекращения, его элементы и порядок их взаимодействия, определено место правопрекращения в механизме правового регулирования имущественных отношений. Сформулировано определение правопрекращающих юридических фактов, установлены их признаки и порядок порождения последствий. Проанализировано функционирование механизма правопрекращения в вещных, обязательственных, деликтных правоотношениях, а также изучены особенности универсальных механизмов правопрекращения. Предназначена для ученых, преподавателей высших юридических учебных заведений, аспирантов, студентов и других субъектов правореализации.
