Le différend sur la banane à l'OMC

Abstract

En septembre 1997, l'Organisation mondiale du commerce (OMC) a condamné l'Organisation commune de marché de la banane (OCMB) mise en place par l'Union européenne. Une analyse du jugement montre que l'OCMB n'est pas condamnée dans sa totalité. Les dispositions remises en cause concernent en fait le système d'allocation des licences d'importation, lié au contingent tarifaire imposé aux bananes dollar, le contingent lui-même étant toléré. Le démantèlement du seul système d'allocation des licences d'importations modifierait essentiellement le partage de la rente de quota entre les opérateurs, mais aurait peu d'effet sur l'équilibre du marché communautaire de la banane, en termes de prix et quantités consommées. En revanche, une refonte globale de l'OCMB, qui remettrait en cause la séparation des régimes d'importation en fonction de la provenance "dollar" ou ACP (Afrique, Caraïbes et Pacifique) des bananes dépendrait étroitement du mode d'allocation des droits à importer dans le régime d'importation unique ainsi institué.
