Abstract

Cet article a pour objectif principal d'analyser le jugement adopté en septembre 1997 par l'Organe de règlement des différends (ORD) de l'Organisation mondiale du commerce (OMC) sur l'OCMB, et d'étudier les réponses possibles de la réglementation communautaire dans ce secteur. Il décrit les modalités de l'OCMB et résume les phases successives du conflit commercial international depuis 1994, qui ont amené à une condamnation de la réglementation européenne à l'OMC. Puis il examine les conclusions de l'OMC qui remettent en cause certaines dispositions de l'OCMB afin de permettre une première analyse du jugement. Il présente enfin les aménagements possibles de l'OCMB en réponse à ce jugement et les effets économiques que l'on peut attendre de ces aménagements.
