Mutation du rapport de subordination : le salarié « autonome » ou l’indépendant « subordonné » en France

Abstract

On assiste actuellement à de profondes mutations des formes d'organisation de travail. Les distinctions entre le travail salarié et le travail indépendant prennent aujourd'hui une dimension nouvelle. En effet, les dernières réformes sociales contribuent à remettre en question la nature du lien entre l'employeur et le salarié et celle du lien entre le donneur d'ordre et le travailleur indépendant. Les données normatives de ces 20 dernières années démontrent que le lien de subordination comme critère d'autorité fait l'objet d'une évolution pour caractériser ces types de relation managériale. Les situations des salariés autonomes et celles des travailleurs indépendants tendent à se rapprocher à travers un rapport de force relevant du pouvoir.
