Abstract

Les Nouvelles Technologies de l'Information et des Télécommunications (NTIC) permettent aujourd'hui le développement d'une offre dématérialisée de monnaies électroniques. Ces moyens de paiement peuvent menacer à terme le monopole étatique de la création de monnaie et modifier en profondeur le fonctionnement des institutions bancaires et financières. Les autorités publiques cherchent aujourd'hui à légiférer pour se protéger de l'émergence de ces nouvelles formes de monnaie, lesquelles peuvent s'apparenter de plus en plus à des monnaies privées. Après avoir, dans un premier temps présenté les modalités de créationa ainsi que les atouts des nouvelles formes de monnaie électronique, ce travail étudie dans un second temps la réponse juridique proposée par les autorités publiques pour protéger leurs revenus de seigneuriage.
