Le principe de la reconnaissance mutuelle au delà du marché intérieur. Phénomène d'exportation normative ou stratégie de "colonialisme" règlementaire?

Abstract

Par le présent article nous nous proposons d'illustrer le phénomène récent d'"exportation normative" du principe de reconnaissance mutuelle, en analysant le phénomène croissant des accords de reconnaissance mutuelle, dans leurs différentes formes, en tant qu'instruments tendant au dépassement des obstacles techniques aux échanges de produits industriels, dans le cadre de l'actuel processus de libéralisation de marché mondial. Invention européenne, ce principe a reçu une consécration officielle dans le cadre des accords OMC et est actuellement utilisé, en égard aux avantages offerts aux échanges intracommunautaires, pour donner lieu à différents types d'accords internationaux visant à faciliter les échanges commerciaux: les accords dits de reconnaissance mutuelle de type traditionnel, les accords de reconnaissance mutuelle basés sur l'équivalence, les protocoles aux accords européens sur l'évaluation de la conformité et l'acceptation des produits industriels, ainsi que les Accords sur l'évaluation de la conformité et l'acceptation des produits industriels
