Abstract

L'économie du droit, bien connue aux Etats-Unis sous le terme de "Law and Economics", demeure encore largement inconnue des juristes français. Pourtant, la relecture du droit sous le prisme économique est assurément un vecteur important du renouveau de la pensée juridique et le droit criminel n'échappe pas à cette analyse critique des institutions. Loin de prétendre à l'exhaustivité, cet ouvrage se donne pour objectif de rendre compte des acquis récents de la recherche en matière d'économie du droit pénal mais également d'essayer d'appliquer ces nouveaux concepts au droit criminel français.
