Réglementation et inefficacité : quelle corrélation ?

Abstract

Le modèle juridique français est-il un obstacle au développement économique ? A en croire le rapport Doing Business 2004 de la Banque mondiale, la réponse ne ferait aucun doute. Sur les questions examinées, les pays de " tradition juridique française " se classeraient presque toujours derrière les Etats relevant de traditions juridiques plus dynamiques, et en particulier, c'est-à-dire derrière ceux qui appartiennent à la famille juridique issue du common law. C'est à cette approche, évidemment caricaturale, qua entendu répondre le colloque international organisé par la Fondation pour l'innovation politique. En privilégiant une vision plus réaliste, et dons moins conflictuelle et plus constructive du rapport entre les modèles ou les systèmes juridiques, ce colloque a mis en lumière les défauts méthodologiques de la démonstration, et dressé un état des forces et des faiblesses du système juridique français. - et des systèmes normatifs qui se rattachent à cette tradition. En somme, il a tenté de rappeler qu'il importe avant tout de bâtir des passerelles, et non d'ériger des frontières.
