Abstract

Dans ce travail nous remettons en cause la vision traditionnelle du brevet en tant qu'outil dont la seule fonction serait d'accroître les incitations à innover et de préserver une diffusion minimale des connaissances. Cette vision se heurte à de profondes contradictions, aussi bien d'ordre théorique qu'empirique. Nous soutenons que ces contradictions peuvent être en grande partie levées lorsqu'on élargit le cadre classique à celui d'une économie fondée sur la connaissance. Raisonner dans ce cadre élargi permet de mettre en évidence les problèmes de coordination qui entravent le processus d'innovation, par opposition à la vision classique qui insiste uniquement sur les problèmes d'incitation. Nous montrons alors que le brevet peut remplir un autre rôle essentiel : celui d'un outil institutionnel permettant de résorber les défaillances de coordination inhérentes à l'innovation collective. Nous concluons en abordant les questions de la diversité sectorielle en matière d'utilisation du brevet à travers les cas polaires de la pharmacie, des semi-conducteurs, des logiciels et des biotechnologies.
