Faut-il appliquer aux sénateurs l’interdiction du cumul des mandats ?

Abstract

Les sénateurs ont fortement remanié le projet de loi d'interdiction des cumuls d'un mandat parlementaire avec une fonction exécutive locale : arguant du principe qu'ils ont une légitimité particulière à être simultanément élus locaux, ils ont voté un amendement destiné à les exclure du dispositif. Cette étude indique pourtant que les sénateurs ne sont guère différents des députés : ils ne sont pas plus nombreux à pratiquer le cumul, et leur survie électorale ne dépend pas davantage de la détention d'un mandat local. En revanche, comme les députés, les sénateurs qui dirigent une collectivité locale participent beaucoup moins aux activités du Parlement. Par rapport au projet initial d'interdiction totale des situations de cumul, une interdiction ciblée sur les plus grandes collectivités aurait des effets limités sur l'amélioration de la participation des députés et sénateurs aux travaux du Parlement.
