La propriété intellectuelle selon Walras. Entre monautopole et majorat littéraire

Abstract

Léon Walras a publié deux articles sur la propriété intellectuelle. En 1859, il conclut, comme les libéraux, à un droit de propriété illimité et perpétuel des auteurs. En 1880, il soutient que la propriété intellectuelle résulte d'un monopole temporaire artificiellement créé par la loi au bénéfice de l'auteur. Pour comprendre le cheminement de Walras, on rappelle d'abord les débats sur le droit d'auteur au milieu du XIXe siècle, en France. On expose ensuite les positions de Walras en 1859 et puis en 1880. Pour saisir les raisons du changement de Walras, on explicite les fondements de son argumentation. Finalement l'article suggère une autre interprétation : Walras n'a pas changé d'opinion, dans la mesure où, dès 1859, il était hostile au droit de propriété perpétuel. En 1880, il a trouvé les moyens de démontrer la position qui avait toujours été la sienne : la propriété intellectuelle est un monopole artificiel temporaire créé par la loi au profit des auteurs.
