Abstract

Cet article montre à partir de l'étude du statut du fermage (1), des coopératives (2) et de l'exploitation agricole (3) que le droit rural français est un droit socio-économique qui s'est développé sur la base d'une théorie économique ignorant le rôle des prix, des institutions de la propriété privée, du profit et de l'entrepreneur dans la coordination. Il soutient que le droit rural est construit sur une théorie objectiviste des phénomènes économiques qui ne l'a rend pas capable de saisir l'importance de l'affectation inter-temporelle des richesses dans la coordination économique. La formation du capital en agriculture s'en trouve alors affectée et les anticipations des acteurs modifiées. Il estime nécessaire, pour ces raisons, une profonde réforme du Code rural.
