Desnacionalização e defesa da concorrência no Brasil: implicações do comportamento do investimento estrangeiro direto

Abstract

Este artigo objetiva desenvolver dois pontos: i) avaliar a importância relativa da aquisição de empresas nacionais por empresas de capital estrangeiro nos casos julgados do CADE; ii) discutir acerca de eventual especificidade de casos de desnacionalização no tocante ao seu impacto sobre a estrutura de mercado. Adicionalmente coloca-se a discussão em aberto acerca de eventual especificidade de casos de desnacionalização, no tocante ao comportamento das inversões produtivas pós-entrada. As conclusões do trabalho permitem avaliar a oportunidade de tratamento diferenciado no exame de atos de concentração de operações que acarretem desnacionalização do parque produtivo doméstico.
