Abstract

El principal objetivo de la reforma laboral pactada y articulada en el Decreto-Ley 32/2021, fue, como es bien conocido, reducir la alta temporalidad contractual de nuestro mercado de trabajo. Esta finalidad exigía dos operaciones complementarias. Por un lado, estrechar los márgenes de la propia temporalidad a sustituciones de trabajadores y circunstancias de producción, derogando el contrato temporal de obra o servicio, como efectúa el vigente art.15 ET. Por otro lado, ampliar los espacios de la contratación indefinida, sin alterar los costes indemnizatorios extintivos, mediante un nuevo contrato de trabajo fijo-discontinuo, con diferentes modalidades, capaz de absorber buena parte de la reducida temporalidad contractual, como se regula en el nuevo art.16 ET.
