Abstract

El 17 de julio de 2009, la sección 17ª de la Audiencia Provincial de Madrid publicó una sentencia en la que absolvía al actual presidente de Telefónica y a su sobrino del delito de uso de información privilegiada por haber prescrito. Varios inversores y empresarios extranjeros manifestaron su enorme perplejidad -no por la absolución por prescripción- sino porque el tribunal dijo que hubo delito. La perplejidad de los inversores y empresarios también provenía de que un Tribunal de un país miembro de la Unión Europea pudiera escribir en una sentencia afirmaciones como las que se recogen en el documento, que contradicen varias evidencias elementales y muy bien documentadas en finanzas.
