Análisis crítico de la Ley 963 de 2005 sobre estabilidad jurídica al inversionista

Abstract

El presente documento analiza la noción de seguridad y estabilidad jurídica para la inversión extranjera a partir de la Ley de Seguridad Jurídica sancionada por el Senado de Colombia en julio del presente ano. En la primera parte se hace un recuento de la inversión extranjera desde una mirada histórica para ver las razones por las cuales se van generando mecanismos de garantía y seguridad a la inversión extranjera, así mismo, se presentan los distintos mecanismos de seguridad y estímulo a la inversión extranjera establecidos en Colombia desde mediados del siglo XX. En la segunda parte se muestran, desde la teoría económica, la noción de seguridad y estabilidad a la inversión. Aquí se subraya la importancia de la nueva economía institucional al involucrar variables jurídicas e institucionales para entender el desempeno de la inversión extranjera. Finalmente, en la tercera parte se analiza la Ley de Estabilidad Jurídica al Inversionista Extranjero (Ley 963 de 2005) y concluimos que si bien es un primer paso para generar incentivos de estabilidad al inversionista extranjero, su eficacia está sujeta a una combinación de otras variables que la ley, por sí sola, no garantiza.
