Ley 789 De 2002: ¿Funcionó O No?

Abstract

Este trabajo presenta una evaluación de la Ley 789 de 2002, conocida como la reforma laboral. La evaluación no sólo tiene en cuenta la evidencia indirecta aportada por las encuestas de hogares, sino también la evidencia directa recopilada por una encuesta empresarial disenada expresamente para medir los efectos de la reforma. El análisis muestra que (i) la reforma tuvo un efecto notable sobre la contratación de aprendices y sobre el subempleo por insuficiencia de horas (especialmente en el sector servicios), (ii) los efectos sobre la generación de empleo y sobre la formalización del empleo fueron inferiores a lo esperado, y (iii) los programas de apoyo al desempleado y de estímulo a la generación de empleo no han funcionado.
