El fideicomiso como instrumento estratégico para la planificación patrimonial sucesoria en la empresa

Abstract

En este trabajo se analiza y propone, una novedosa aplicación del fideicomiso a nivel empresario, profundizando a partir del artículo 3 de la Ley 24.441 y del nuevo Código Civil y Comercial de Argentina, en el fideicomiso testamentario pero con una aplicación eminentemente práctica, en beneficio de la vigencia, preservación y sustentabilidad inteligente de los proyectos consolidados de la economía real. Se propone la herramienta del fideicomiso como la innovación estratégica que permitiría reflejar los objetivos e intereses empresarios fundacionales, el esfuerzo y la realidad lograda por sobre los intereses coyunturales individuales, los conflictos familiares y las debilidades empresariales que podrían perjudicar a las futuros herederos, especialmente los menores e incapaces, y a la comunidad relacionada.
