Reglementation des Donnees en Afrique : Libre Circulation des Donnees, Regimes de Donnees Ouvertes et Cyber Securite

Abstract

Globalement, cette etude vise a repondre aux preoccupations relatives a la reglementation des donnees sur le continent africain. En particulier, le document se concentre sur trois aspects majeurs de la reglementation des donnees qui tiennent les ficelles du developpement potentiel du continent. Il s'agit de la libre circulation des donnees, de l'adoption de regimes de donnees ouvertes et de la cyber securite. Cela se fera dans le contexte general de l'Afrique, en mettant l'accent sur les instruments reglementaires des differents organismes au niveau continental et sous regional, et sur certaines legislations nationales des pays qui ont developpe des instruments legislatifs repondant aux maªmes preoccupations. L'accent sera egalement mis sur les progra¨s realises par l'Union europeenne, premier organisme continental a avoir adopte une approche geographiquement concertee en matia¨re de reglementation globale des donnees. L'objectif est de tirer les lea§ons de ces efforts dans le but de determiner une approche centree sur l'Afrique de la reglementation des donnees, en particulier dans le contexte de l'accroissement du commerce interafricain envisage par l'accord sur la zone de libre-echange continentale africaine, et d'une economie numerique renforcee, comme le preconise la strategie de transformation numerique pour l'Afrique (2020-2030).
