Abstract

Der Beitrag geht von der Einschätzung aus, dass sich der Rechtsrahmen für das Raumordnungsverfahren im Wesentlichen bewährt hat und durch das ROG 2017 in zwei Einzelpunkten verbessert worden ist. Die Verfasser halten jedoch eine Diskussion für erforderlich, ob und in welcher Weise die Rechtsgrundlagen weiterentwickelt und geschärft werden sollten. Der Beitrag spricht in diesem Sinne Erleichterungen bei der Prüfung des Einsatzbereichs von Raumordnungsverfahren, die Befugnis der Raumordnungsbehörde zur Benennung von (eigenen) Alternativen/Varianten, die Frage nach einer höheren Verbindlichkeit des Verfahrensergebnisses und die Forderung nach einer stärkeren Stellung betroffener Regionalplanungsträger im Raumordnungsverfahren an. Die Verfasser sprechen sich insbesondere für eine Erhöhung der Bindungswirkung der Ergebnisse eines Raumordnungsverfahrens aus, die aber in besonderen Fallkonstellationen überwindbar sein soll.
