Digital Platforms: A Challenge for States?

Abstract

The paper examines the problems posed by the emergence and development of digital platforms from the perspective of states. Platforms are the protagonists of the digital transformation, having great power and influence capacity, particularly because they mainly act at a transnational level. Platforms are a category of non-state actors that both question and challenge the power of states. In legal terms, the presence and activity of platforms do not readily conform to the traditional parameters concerning the applicability of law, submission to the jurisdiction of the state, and taxation. The traditional criteria of territorial and personal jurisdiction are not easily applicable to these major stakeholders of the globalized society. Enlarged and strengthened international cooperation is, for the time being, the only possible solution to the political and legal challenge posed by digital platforms.
