Abstract

Zusammenfassung Jener Teilbereich der Tätigkeiten der Selbstverwaltungskörper des Wirtschafts- und Soziallebens, in dem diese unter Einsatz von imperium, also hoheitlich, tätig werden, ist nach seiner Funktion spezifisch, nämlich dezentralisiert, organisierte Staatstätigkeit. Sie ist, wie Pernthaler formuliert, „Staatsverwaltung im funktionellen Sinn“123. Diese Tätigkeit spielt sich im wesentlichen in drei Bereichen ab: als Führung von Agenden der Staatsverwaltung nach besonderen gesetzlichen Bestimmungen124; als Erlassen von Satzungen für den eigenen Bereich125 und als Tätigwerden im Umlagenverfahren126.
