Abstract

Zusammenfassung Bei der engen Verflechtung zwischen Wirtschaft und Recht spielt die Frage, aus welchen Quellen dieses Recht fließt, und wie die Verfassung des Staates aufgebaut ist, eine wichtige Rolle. Denn wenn Gott als der, gleichgültig ob unmittelbare oder mittelbare Gesetzgeber der Rechtsordnung im allgemeinen und des Wirtschaftsrechts im besonderen auftritt, dann ist der Satz Ex 22, 25: (Wenn Du das Kleid Deines Genossen gepfändet hast, so sollst Du es ihm bis Sonnenuntergang zurückgeben), gött1iches Wirtschaftsrecht, und auch die Wertung dieses Rechts erscheint durch diesen Umstand wesentlich beeinflußt.
