Abstract

Zusammenfassung Politischer Wille, berufliche und gesellschaftliche Normen sowie Gesetze sind wichtige Rahmenbedingungen für Entwicklung und Akzeptanz von Mediation in der Gesellschaft. Darauf aufbauend entwickelt sich ein regulierter Markt (etwa durch verpflichtende Mediationsversuche bei Gerichtsverfahren) oder ein freier Markt (durch freiberufliches Angebot). Das Bedürfnis westlicher Gesellschaften nach Harmonie und einvernehmlicher Konfliktlösung statt Konfrontation und Machtausübung wird den Durchbruch mediativer Dienstleistungen im Allgemeinen und von Mediation im Besonderen früher oder später ermöglichen. Welche Art der Konfliktbearbeitung entspricht den gesellschaftlichen Normen? Worin liegen die Bedürfnisse der Bevölkerung im Umgang mit Konflikten? Was entspricht der Mentalität und Kultur aktuell am meisten? Wie müssten sich die Gepflogenheiten durch Veränderungen in der Gesellschaftsstruktur anpassen? In diesem Kapitel werden die vom Umfeld vorgegebenen Rahmenbedingungen beleuchtet. Geklärt wird, welchen Einfluss diese Rahmenbedingungen auf die Entwicklung mediativer Dienstleistungen haben.
