Abstract

Zusammenfassung Das Recht wirkt auf die Wirtschaftsmediation auf vielfältige Weise ein. Wesentlich ist die Unterscheidung hinsichtlich der Rechtslage, die auf den Anlassfall der Mediation wirkt und bezüglich des rechtlichen Rahmens, der Aspekte des Verfahrens der Mediation selbst und der daran Beteiligten prägt. Nur der zweite Aspekt ist in diesem Kontext einer generalisierten Darstellung zugänglich, die hier für den gesamten DACH-Raum erfolgt. Folgende Fragen werden erörtert: Welche gesetzlichen Bestimmungen und Qualitätsstandards prägen die Tätigkeit von Wirtschaftsmediator*innen? Inwiefern ist das Mediationsverfahren gesetzlich geregelt und welche Anschlussstellen zu anderen Methoden der Konfliktbearbeitung gibt es? Welche rechtlichen Aspekte und Qualitätsstandards sind für die Beteiligten an einer Mediation wesentlich? Als Ergebnis der Erörterung werden die rechtlichen Konturen dieser Konfliktbeilegungsmethode geschärft. Die Kenntnis und Beachtung der vom Recht gezogenen Grenzen gibt Orientierung und Sicherheit bei der Konfliktbearbeitung.
