Sind Patente tatsächlich ein Hindernis für Folgeinnovationen?

Abstract

Zusammenfassung Dass der Patentschutz die weitere Nutzung von Forschungserkenntnissen erschwert und neue Innovationen verlangsamt, ist eine verbreitete Hypothese. Die vorliegende Studie aus dem Bereich der Genforschung untersucht, wie oft wissenschaftliche Erkenntnisse über bestimmte Gene in weiteren Forschungsarbeiten und klinischen Studien Verwendung finden. Der tatsächliche Patentstatus einer DNA-Sequenz spielt dabei nur eine geringe Rolle. Wichtig ist stattdessen, ob überhaupt ein Patentantrag gestellt wurde, nicht aber, ob diesem auch stattgegeben wurde. Diese Ergebnisse stellen die Hypothese infrage. Denn sie legen nahe, dass der Patentschutz Folgeinnovationen zumindest im medizinisch-pharmazeutischen Bereich kaum hemmt.
