Abstract

Zusammenfassung Ist eine befristete Aufhebung des Patentschutzes der Covid-19-Impfstoffe ein geeignetes Mittel zur Pandemiebekämpfung? Die Befürworter argumentieren, dass damit eine raschere Ausweitung der Produktion und Versorgung mit Impfstoffen möglich wäre. Aber welche Folgen hat eine Aufweichung des Patentschutzes für die Forschungsanreize der Unternehmen und für künftige Innovationen? Die vorliegende Studie zeigt, dass die Forschungs- und Innovationstätigkeit der Unternehmen in Folge einer Abschwächung des Patentschutzes deutlich zurückgeht. Start-ups und kleinere und mittlere Unternehmen (KMU), die nur begrenzte Möglichkeiten zur Lizensierung oder zum Verkauf ihrer Patente haben, sind besonders von einem effektiven Patentschutz abhängig.
