Abstract

Zusammenfassung Ob der Bundes- oder der Landesgesetzgeber zur Konkretisierung der Basiselemente des Daseins und der Basis-Grundversorgung in bestimmten Sachbereichen aufgerufen ist, beurteilt sich nach der grundgesetzlichen Kompetenzverteilung. Da sich in den Gesetzgebungskompetenzkatalogen der Art. 73 und 74 GG wenige Anhaltspunkte (Schienenverkehr, Postwesen und Telekommunikation, Recht der Wirtschaft usw.) finden lassen, sind- soweit die Verantwortung für das Dasein der Bürger also „durch Gesetze“ verwirklicht werden soll – im Zweifel nach Art. 70 Abs. 1 GG die Länder handlungsberechtigt und in engen Grenzen auch handlungsverpflichtet. Für die (gesetzesfreie) Verwaltung besteht aufgrund des Art. 30 GG ein Handlungsvorrang zu Gunsten der Landes-, einschließlich der Kommunalverwaltungen, die sich für Aktivitäten im Bereich der Daseinsvorsorge auf die kommunale Selbstverwaltungsgarantie berufen können.
