Abstract

Zusammenfassung Der Datenraum Gesundheit ist einer von zehn Datenräumen, die initial von der EU im Rahmen der Europäischen Datenstrategie aufgebaut werden sollen. Grundlage hierfür ist der „European Health Data Space“ Verordnungs-Entwurf, der am 3. Mai 2022 von der Europäischen Kommission veröffentlicht wurde, und der sich bei Erstellung dieses Beitrags im August 2023 noch in Verhandlungen im Europäischen Parlament und im Rat befand. In Deutschland hat die Bundesregierung mit dem Regierungsentwurf zum Gesundheitsdatennutzungsgesetz (GDNG) am 30.08.2023 einen wichtigen Aufschlag gemacht, um notwendige nationale Strukturen für den Anschluss an den EHDS zu etablieren. Der folgende Beitrag fokussiert sich auf die Darstellung der geplanten Infrastruktur des Europäischen Datenraums und auf die dort perspektivisch zu nutzenden, elektronischen Gesundheitsdaten. Zudem wird auf die, im deutschen Gesundheitssystem geplante „Umsetzungsbrücke“ eingegangen, die mit dem Regierungsentwurf zum Gesundheitsdatennutzungsgesetz (GDNG) initial geschaffen wurde. Ausgehend von diesen Grundlagen werden daraus resultierende, mögliche Implikationen für ausgewählte Stakeholder und das Health Data Management im Gesundheitswesen aufgezeigt.
