Abstract

Zusammenfassung Marketing-Fachleute betrachten den Datenschutz aus der Marketingperspektive und nehmen die vielen „Neins“ des Datenschutzes häufig als nachträgliche Einschränkung und Zensur ihrer Marketingideen und Konzepte wahr. Versetzt man sich umgekehrt in die Datenschutzperspektive, sieht das Bild jedoch anders aus. Denn es geht darum, dass man für die Verarbeitung von Kundendaten – immer – einen gesetzlichen Erlaubnistatbestand benötigt, weil die Verarbeitung von Kundendaten per se zunächst verboten ist. Ziel dieses Kapitels ist es, aus der Datenschutzperspektive einen Fahrplan als Checkliste für die zulässige Verarbeitung von personenbezogenen Daten zu Marketingzwecken zu erstellen.
