Abstract

Zusammenfassung Eine Abmahnung ist nur wirksam, wenn sie von einer abmahnungsberechtigten Person erteilt wird. Mit dem Ausspruch einer Abmahnung wird nicht in den Bestand des Arbeitsverhältnisses eingegriffen, vielmehr soll der betroffene Arbeitnehmer zu einer Verhaltensänderung bewegt werden. Daher sind nicht nur kündigungsberechtigte Personen abmahnungsberechtigt, sondern alle Mitarbeiter, die aufgrund ihrer Aufgabenstellung dazu befugt sind, verbindliche Anweisungen bezüglich des Ortes, der Zeit sowie der Art und Weise der arbeitsvertraglich geschuldeten Arbeitsleistung zu erteilen.
