Abstract

Zusammenfassung Die Stiftung stellt eine vom Stifter errichtete Organisation dar, die mithilfe des der Stiftung gewidmeten Vermögens einen vom Stifter festgelegten Zweck dauerhaft erfüllen soll. Im Unterschied zu Vermögen bei Gesellschaften und Körperschaften bildet das Stiftungsvermögen ein rechtlich verselbstständigtes Objekt, dem durch die Widmung des Stifters eine bestimmte Zweckrichtung vorgegeben wurde. Der Stifter trennt sich somit nach Maßgabe der Übertragungspflicht des § 82 BGB dauerhaft von seinem Vermögen und erhält es nach Erlöschen der Stiftung auch nicht automatisch zurück (vgl. § 88 BGB).
