Abstract

Zusammenfassung Der maßgebliche rechtliche Rahmen der Testamentsvollstreckung ergibt sich aus dem Fünften Buch des BGB, dort dem Sechsten Titel des dritten Abschnitts (§§ 2197–2228 BGB). Auch weitere erbrechtliche Vorschriften, namentlich die §§ 2042, 2306, 2338, 2363, 2368, 2376 BGB, weisen Bezugspunkte zur Testamentsvollstreckung auf. Das Verhältnis zwischen Testamentsvollstrecker und Erben wird im Wesentlichen durch die Bestimmungen des Auftragsrechts (§§ 662 ff. BGB) gestaltet. Neben seiner materiell-rechtlichen Ausformung im BGB wird das Institut der Testamentsvollstreckung durch zivilverfahrens- und vollstreckungsrechtliche Bestimmungen, insbesondere in den §§ 114 Abs. 3, 243, 327, 728, 748, 779, 780, 863, 991 ZPO; §§ 352 ff. FamFG; §§ 317, 320 InsO, ergänzt.
