Abstract

Zusammenfassung Erbschaftsbesitzer ist nach der in § 2018 BGB enthaltenen Definition derjenige, der aufgrund eines ihm in Wirklichkeit nicht zustehenden Erbrechts etwas aus der Erbschaft erlangt hat. Eine Person tritt hier als Erbe auf, maßt sich ein tatsächlich nicht bestehendes Erbrecht an und hat teils oder vollständig die Erbschaft oder einzelne Vermögensgegenstände oder -vorteile hieraus erhalten. Der Begriff des Erbschaftsbesitzes beinhaltet mithin eine objektive Voraussetzung (etwas aus der Erbschaft Erlangtes) und eine subjektive Komponente (aufgrund eines in Wirklichkeit nicht bestehenden Erbrechts).
