Abstract

Zusammenfassung Es gibt viele Gründe dafür, dass ein Erbe oder Miterbe die ihm angefallene Erbschaft oder den ihm angefallenen Miterbenanteil nicht selbst verwalten und abwickeln kann oder will. Besonders häufig liegt der Grund hierfür darin, dass die Verwaltung oder Abwicklung der Nachlassgegenstände besonderes Know-how oder hohen Zeitaufwand erfordern oder andere Beteiligte vorhanden sind, mit denen der Erbe oder Miterbe nichts zu tun haben möchte. Nicht selten besteht der Grund aber auch darin, dass hohe oder unbekannte Nachlassverbindlichkeiten dazu führen, dass mit der Verwaltung oder Abwicklung des Nachlasses ein persönliches Haftungsrisiko für den Erben oder Miterben verbunden ist, dem sich dieser nicht aussetzen möchte. Die gesetzlich vorgesehenen Varianten der Nachlass-Fremd-Verwaltung (nämlich die Nachlasspflegschaft, die Nachlassverwaltung, die Testamentsvollstreckung und die Nachlassinsolvenzverwaltung) sind oft aus diesem oder jenem Grund nicht geeignet, um der Interessenlage gerecht zu werden:
