Abstract

Zusammenfassung Bis zum Inkrafttreten des „Personal Information Protection Law“ („PIP Law“) im November 2021 stellen Standards für den Schutz personenbezogener Daten die wesentliche Grundlage dar. Mit empfohlenen Standards testet die chinesische Regierung teilweise neue Themen am Markt, bevor die Materie in Gesetzesform gegossen wird. Im Bereich Datenschutz spielt der empfohlene Standard „Personal Information Security Specification“ („PI Specification“) eine zentrale Rolle. Es ist davon auszugehen, dass die PI Specification (ggf. in angepasster Form) neben dem PIP Law bestehen bleiben wird. Jedenfalls sind die Mustertexte (z. B. für Datenschutzerklärungen) der PI Specification in der Praxis hilfreich und bleiben auch nach dem Inkrafttreten des PIP Law relevant. Daneben gibt es weitere Standards mit spezifischen Vorgaben zu Einzelaspekten im Datenschutz. Besonders internationale Unternehmen benötigen einen Überblick über die Rechtslage im Datenschutz. Denn beim grenzüberschreitenden Datenaustausch gibt es zukünftig Einschränkungen. Zudem müssen Unternehmen Daten lokal in China speichern, sofern bestimmte Schwellenwerte überschritten werden.
