Abstract

Zusammenfassung Dem LkSG liegt eine weite Fassung des Lieferkettenbegriffs zugrunde, um sämtliche Produkte und Dienstleistungen eines Unternehmens zu erfassen. Diese Schritte sind regelmäßig im In- und Ausland zur Herstellung der Produkte und zur Erbringung der Dienstleistungen erforderlich. Legaldefiniert handelt es sich um den gesamten Weg von der Rohstoffgewinnung bis zur Lieferung an den Endkunden (vgl. § 2 Abs. 5 S. 2 LkSG). Die Lieferkette enthält verschiedene Elemente, deren Unterteilung sich letztlich auf die Sorgfaltspflichten, insbesondere die Präventions- und Abhilfemaßnahmen auswirkt. Erfasst wird das Handeln des Unternehmens im eigenen Geschäftsbereich (§ 2 Abs. 5 Nr. 1, Abs. 6 LkSG), das Handeln eines unmittelbaren Zulieferers (§ 2 Abs. 5 Nr. 2, Abs. 7 LkSG) sowie das Handeln eines mittelbaren Zulieferers (§ 2 Abs. 5 Nr. 3, Abs. 8 LkSG). Die Überprüfungspflicht gilt damit für die gesamte Lieferkette.
