Abstract

Zusammenfassung Vermehrt bietet die öffentliche Verwaltung Dienstleistungen und Produkte online an. Viele dieser Angebote verlangen von den Benutzenden, dass sie sich, etwa durch die Eingabe von Benutzerdaten, identifizieren. Auf diese Weise kreierte „digitale Identitäten“ existieren oftmals neben anderen Online-Identitäten aus dem privaten Rechtsverkehr. Dies stellt insbesondere für den Bürger, welcher all diese Zugänge besitzt, keine optimale Lösung und ein Hindernis für die Durchsetzung des elektronischen Rechtsverkehrs dar. Im vorliegenden Beitrag wird beleuchtet, weswegen die Rechtsordnung gewisse Voraussetzungen hinsichtlich der Identifizierung der Verfahrensbeteiligten setzen muss und welche verschiedenen Identifizierungsmöglichkeiten gegenüber Behörden im Internet existieren. Schlussendlich sollen künftige Entwicklungen in diesem Bereich aufgezeigt und bewertet werden, durch welche die Identifizierung im digitalen Raum für alle Beteiligten künftig verbessert werden könnte.
