Abstract

Zusammenfassung Forfaitierung: Forfaitierung ist der Ankauf mittel- und langfristiger Exportforderungen unter Verzicht des Rückgriffs auf den Forderungsverkäufer im Fall der Nichtzahlung durch den Schuldner. Der Forfaitierung liegt ein Kaufvertrag zwischen dem Exporteur (Forderungsverkäufer/Forfaitist) und einer Bank bzw. einem Spezialinstitut (Forderungskäufer) zugrunde. Durch eine Forfaitierung gehen alle Rechte aus der Forderung, aber auch die Risiken auf den Forfaiteur (Forderungskäufer) über. Bei Zahlungsunfähigkeit des Schuldners kann der Forfaiteur keinen Rückgriff auf den Forderungsverkäufer nehmen, da er die wirtschaftlichen und politischen Risiken trägt, z. B. wenn sich die politischen und wirtschaftlichen Verhältnisse im Lande des Importeurs durch Unruhen, Streiks oder kriegerische Auseinandersetzungen verschlechtern und die Zahlungsverpflichtungen aus diesen Gründen nicht erfüllt warden können. Der Forfaiteur muss außerdem beachten, dass er ein Transfer-, Konvertierungs- und Währungsrisiko zu tragen hat. Der Exporteur haftet lediglich für den rechtlichen Bestand der Forderungen und ist verpflichtet, für Mängelrügen, die vom Importeur geltend gemacht werden könnten, einzustehen (Mängelbeseitigungsrisiko).
