Abstract

Zusammenfassung Auf nationaler Ebene wird der Betrieb von UAS luftrechtlich maßgeblich durch das Luftverkehrsgesetz (LuftVG), die Luftverkehrs-Ordnung (LuftVO) und die Luftverkehrs-Zulassung-Ordnung (LuftVZO) geregelt. Auf europäischer Ebene sind die Delegierte Verordnung (EU) 2019/945 und die Durchführungsverordnung (EU) 2019/947 anzuwenden (s. dazu Abschn. 2.2), wobei erstere maßgeblich die Konstruktion und Herstellung von UAS zum Gegenstand hat und zweite insbesondere detaillierte Bestimmungen für den Betrieb von UAS sowie für das Personal enthält. Die Durchführungsverordnung (EU) 2019/947 gilt seit 31. Dezember 2020 unmittelbar in den Mitgliedsstaaten. Sofern das deutsche Recht in Erwartung der in Arbeit befindlichen Anpassung dem unmittelbar geltenden EU-Recht derzeit noch entgegensteht, wird hierauf im Folgenden gesondert hingewiesen. Darüber hinaus hat das damalige Bundesministerium für Verkehr und digitale Infrastruktur (BMVI) im Dezember 2020 einen Referentenentwurf (in der Folge „RefE“) veröffentlicht, aus dem hervorgeht, inwiefern das nationale Luftrecht an die Durchführungsverordnung (EU) 2019/947 angepasst werden soll. Die nachfolgenden Ausführungen sind daher stets vor diesem Hintergrund zu lesen.
