Abstract

Arbeitgeber sind über das Lohnsteuerverfahren gesetzlich zum Steuereinbehalt bei Lohn- und Gehaltszahlungen an ihre Mitarbeiter verpflichtet. Diese vom Staat aufgebürdete Verpflichtung ist sanktions- und haftungsbewährt. Mit der Lohnsteuer-Anrufungsauskunft nach § 42e EStG besteht für die Beteiligten ein gebührenfreier Auskunftsanspruch gegenüber dem Finanzamt. Der Beitrag stellt das Instrument vor, setzt sich kritisch mit der diesbezüglichen höchstrichterlichen Rechtsprechung sowie den Ansichten der Finanzverwaltung auseinander und gibt zudem Hinweise zu gesetzlichen Anpassungsmöglichkeiten.
