Abstract

Zusammenfassung Im folgenden Kapitel betrachten wir eine Reihe von Situationen und Fallbeispielen, in denen im Arbeitskontext häufig Unsicherheiten zutage treten und es aufgrund von Unwissenheit über rechtliche Möglichkeiten zu Benachteiligungen und Missverständnissen bis hin zu Konflikten kommen kann. Diese Situationen stammen anekdotisch aus der anwaltlichen und der Beratungspraxis. Wir haben die Beispiele verallgemeinert und abstrahiert von konkreten Einzelfällen dargestellt. Die ausgewählten Situationen und Fallkonstellationen sind nicht abschließend, stellen jedoch die nach unserer Erfahrung im Arbeitsalltag vermutlich am häufigsten vorkommenden Fragestellungen, Herausforderungen und Reibungspunkte dar. Betrachtungen im Zusammenhang mit den Besonderheiten öffentlich-rechtlicher Dienstverhältnisse im Zusammenhang mit Transidentität werden in Kap. 5 ausgeführt.
