Abstract

Zusammenfassung Der Beitrag befasst sich mit der Misere vor allem von Krankenhausärzten, die bedingt durch die COVID-19-Pandemie gezwungen sind, über die Verteilung von knapp gewordenen Intensiv- und Beatmungsressourcen zu entscheiden. Betrachtet werden die strafrechtlichen und zivilrechtlichen Konsequenzen für Ärzte und für das Krankenhaus. Zentrale Aspekte der Betrachtung bilden die Rechtfertigung der Triage-Entscheidung über eine Pflichtenkollision, die zugrunde zu legenden Kriterien bei Triage-Entscheidungen sowie die Pflicht zur Behandlung.
