Abstract

Zusammenfassung Das Kapitel befasst sich mit den wichtigsten internationalen Institutionen aus der Perspektive des Völkerrechts und des internationalen Handels und vergleicht ihre Bedeutung in Gesetzgebung und Politikgestaltung. Das Verständnis der Funktionsweisen dieser Institutionen erleichtert die Nachvollziehbarkeit, wie völkerrechtliche – in unserem Fall meist handelsrechtliche – Regelungen verabschiedet werden. Darüber hinaus haben diese Institutionen, wie z. B. die Welthandelsorganisation, erhebliche Auswirkungen auf die Wirtschaft. Andere, wie die Schiedsgerichtsbarkeit der Internationalen Handelskammer, bieten Möglichkeiten zur außergerichtlichen Streitschlichtung. Des Weiteren werden die grundlegenden Unterschiede zwischen den wichtigsten Rechtssystemen auf der Welt erörtert, um die damit verbundenen Probleme in der Rechtsanwendung und Durchsetzung aufzuzeigen. Abschließend wird auf die Herausforderungen im Völker- und internationalen Handelsrecht sowie den daraus folgenden Motiven für die Rechtsvereinheitlichung und die Grundlagen des Internationalen Privatrechts eingegangen.
