Abstract

Zusammenfassung Der Rückbau sämtlicher Bankgeschäfte sowie bilanzieller als auch nicht-bilanzieller Positionen einer Bankbilanz im Rahmen einer Fortführungsprognose – im sogenannten Going Concern – unter Beibehaltung der allgemeinen Bankerlaubnis zum Betreiben von Bankgeschäften gemäß den Regelungen des Kreditwesengesetzes ist in Deutschland noch eine absolute Ausnahme. Beginnend im Jahr 2012 wurden sowohl die VALOVIS BANK Aktiengesellschaft als auch die Düsseldorfer Hypothekenbank Aktiengesellschaft nach erfolgten Stützungsmaßnahmen durch den Bundesverband deutscher Banken e.V., Einlagensicherungsfonds in den geordneten Rückbau im Going Concern überführt. Das folgende Kapitel stellt die verschiedenen durchgeführten Maßnahmen auf Basis öffentlich zugänglicher Informationen am Beispiel der VALOVIS BANK Aktiengesellschaft dar.
