European Energy Policy on the Basis of the New Provisions in the Treaty of Lisbon

Abstract

The Lisbon Treaty is intended to introduce a significant number of changes to the European Union's primary law, including the creation of a legal basis for an autonomous energy policy. Article 194 of the Treaty on the Functioning of the European Union (TFEU) provides the facility for a broad range of measures in the energy sector. In view of the most recent progress of Union activities in this sector, it is expected that the new competence will be exercised on a large scale even if the Lisbon Treaty does not come into force. This chapter outlines substance and scope of the prospective European Energy Policy by examining the objectives and guiding principles of Art. 194 TFEU.
